Will of George GOODWIN - Probate 12 September 1861

This is the last Will and Testament of me George GOODWIN of Great Wigston in the county of Leicester

I direct that all my just debts, funeral and testamentary expenses be fully paid and satisfied I appoint my two friends William GOODWIN gardener and Henry GLENN grocer and chandler both of Great Wigston aforesaid Trustees and Executors of this my Will I give devise and bequeath unto my dear wife Elizabeth GOODWIN all my household goods and furniture, plate, linen and china. printed books and all other my household stuf and effects of which I shall die siezed of or posses for her own use and benefit and to be entirely at her disposal

And also give unto my said wife Elizabeth GOODWIN the interest of all my monies and the rents issues and profits arising from my freehold houses and premises for and during the term of her natural life subject to her keeping the same in good and tenantable repair

I give and devise unto the said William DOODWIN and Henry GLENN their heirs and assigns all my monies and securities for money with all and every my Messuages, Lands, Tenanents, Heriditaments and real estate whatsoever of which I shall die seized orpsooessed I also devise to them all the the estate vested in me upon any trust or by way of Mortage according to the nature and quality thereof respectively but nethertheless upon the trust and subject to the equity of redemption which shall be subsisting or capable of taking effect therein at the time of my decease

And I do hereby declare that the receipt or receipts in writing of my said Trustees or Trustee or the survivors of them his heirs executors administrators or assigns for the interest arising from my personal estate or the rents arising from my freehold property and for all other trust monies which they shall receive under or by virtue of the trust hereby in them reposed bt this my Will shall effectively discharge the person or persons so paying the same for so much as in such receipt shall be expressed to be received and such person or persons so paying money as aforesaid shall not after such receipt given be obliged to see to the application of such monies or be answerable or accountable for the missapplication or non asppliance thereof or of any part thereof.

And I do hereby declare my Will to be that my said Trustees or the survivors of them his heirs executors administrators or assigns shall stand and be possessed of my personal estate which shall consist of monies and securities for money and also of the rents and profits which shall arise from my real estate upon the trust following (that is to say) upon trust to pay the interest arising from my personal property and the rents arising from my freehold property unto my said wife Elizabeth GOODWIN or suffer them to be received by her or her assigns for and during the term of her natural life provided also and I hereby further declare that no person named or becoming trustee in under or in consequence of this my Will shall be answerable or accountable for more of the aforesaid trust monies or premises than shall actually recieve notwithstanding the jooining in or signing any reciept by way of conformity nor otherwise than for his own acts, deeds, receipts neglects or defaults only nor for any loss damage or nisfortune which shall or may happen of or to the saif trust monies and premises by the failure or deffect of any bank, banker or security whereon or wherein or with whom the same shall be put placed out or deposited for the safe custody or otherwise so as such loss damage or misfortune happen without his willful default or neglect.

And that it shall be lawfull to and for my said trustees their respective heirs, executors, admin istrators and assigns to retain and reimburse himself and themselves all cost charges damages and expenses which they respectively shall or may sustain suffer expend or disburse on or about the execution of the trust hereby in them reposed and it shall be lawful for anf I hereby empower my said trustees of the survivors of them his heirs, administrators and assigns to alter vary and transpose the stocks finds and securities in which the said trust monies shall be laid out and invested for into and upon other stocks finds or securities at their discretion

As soon as convenient after the decease of my said wife I direct my said trustees or the survivors of them his heirs, executors or assigns to call in all monies or the aforesaid trust and after paying my wife'sfuneral expenses and all other expenses they may have been put ot and have incurred in the execution of the trust of this my Will to pay the whole of the aforesaid trust monies unto my daughter Jane FORRYAN and her assigns saving and excepting the £220 owing to me onmortage on the house and premises of the late John PERKINS baker in the Bull Head Street Great Wigston which mortage or money I gave and bequeathed unto my son John GOODWIN his heirs, or assigns. My freehold house and brewhouse yard garden and premises situated in the Bell Street Great Wigston and know by the name of King William the Fourth now in occupation of my son John GOODWIN from my decease I direct him to pay unto his mother the sum of £5 per annum as rent for the same at the decease of my said wife I give saif house and premises unto my son Jogn GOODWIN and his wife Mary Ann for and during the term of their natural lives subject to their keeping the same in good and tenantable repair and further subject to their keeping it free from debt by mortage or otherwise At the decease of my said son John GOODWIN and his wife Mary Ann I give and devise and bequeath the said house, brewhouse, yard, temament premises and appurtenances to my daughter Jane FORRYAN her heirs and assigns for ever.

My free hold house where I now dwell with those adjoining now in the occupation of Hill and Minor at the decease of my said wife I give and bequeath unto my daughter Jane FORRYAN her heirs and assigns for ever.

My freehold houses, yard, gardens, tenament and premises situated in Bush Lane Great Wigston now in the occupation of Eli BAILEY and othersat the decease of my said wife I give and bequeath unto my son John GOODWIN his heirs and assigns for ever.
